This Privacy Policy applies to Post Planner LLC, (“Post Planner”, “we”, “us” and “our”).

Post Planner is committed to ensuring the privacy of your Personal Data. We are further committed to preventing unauthorized access to that information. Our Privacy Policy details what Personal Data is collected from our customers, users, business representatives, and others and explains how we use it, how it is stored, and your choices related to our use of your information.

1. WHO WE ARE

Post Planner is a social media application that generates social media engagement for businesses and individuals. Our application analyzes content from tens of thousands of feeds across the web to identify top-performing content that resonates with audiences and can be used to build a custom library of valuable content sources. Application features enable media content to be scheduled across multiple social channels with bulk uploading. The application streamlines and automates social media publishing. Other features manage and analyze your posts and review and recycle your best performing posts. Our blog site provides social media tips and training to maximize marketing effectiveness.

Post Planner is based in Utah, located in the United States. We operate the Post Planner software application, blog, the website located at https://www.postplanner.com/, and related services and business activities (collectively referred to as “Services”). We respect your privacy and take safeguarding your data seriously. Please read this Privacy Policy carefully, available at https://www.postplanner.com/terms/privacy, together with the Terms of Service (“Terms”) available at https://www.postplanner.com/terms, which governs your use of the Services, to understand what Personal Data (defined below) we collect from you, how we use it, and your choices related to our use of your Personal Data. If you do not agree with this Privacy Policy, please do not use the Services.

2. WHAT IS PERSONAL DATA?

“Personal Data” means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person. Under specific laws, Personal Data may include any information relating to a household.

3. PERSONAL DATA WE PROCESS

We process Personal Data that you actively submit to us, that we automatically collect through your use of our Services, and that we collect from third-party sources. We may process your Personal Data with or without automatic means, including collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction of your Personal Data.

Personal Data that you actively submit to us.

We collect Personal Data that you actively submit to us through your account, provide comments and suggestions, post on forums, sign up for newsletters, enter promotions, interact with us on our social media channels, place orders, post information through the Services, submit content, or send us feedback. Examples are provided below. You will know when we collect your Personal Data because we will directly ask you for the information. We will require certain Personal Data for you to use our Services or for us to be able to contact you. There may also be circumstances where providing Personal Data is optional and does not impact your access to Services.

Your Account. When you sign up for an account, you may join using your name and email. Or you may join with your Facebook account. Post Planner stores this information to help identify you when you log in. Once you've registered, you create a user profile that includes your first name, last name, email address, and phone number. We also collect your payment information such as debit card or credit card details or your PayPal account information to process payment for our Services.

Communication Subscription. If you choose to sign up for our communications, we will collect your email address.

Social Media Accounts. We integrate with social media platforms and give the option to add your Facebook page or group, X/Twitter account, LinkedIn profile or page, Instagram account, Google Business Profile, Pinterest profile or business page and/or YouTube account to your social media profiles.

Support Request. We collect information about the technical issue, privacy inquiry, other inquiry, your device, and your email address when you submit an email to our support services.

Testimonials. We invite you to send us your success story and collect your name and email address along with information you provide on how Post Planner gets results for you. We may publish your testimonial on our website or blog.

Personal Data we automatically collect through your use of the Services.

We receive some Personal Data automatically when you visit Post Planner Services. This includes information about the device, browser, and operating system you use when accessing our Services, your IP address, the website that referred you, which pages you request and visit, and the date and time of each request you make.

Personal Data we collect from third-party sources.

We integrate with third-party service providers that may share Personal Data with us in connection with your use of our Services. For example, when you sign up with Facebook or add a Facebook page or group or your X/Twitter account to your social media profile, we collect Personal Data from these third-party service providers. We also collect Personal Data of potential customers through referrals, usually collecting a name and email address. 

Personal Data we collect from connected social media accounts

If you connect your third party social media account to your Post Planner account, we may collect certain information stored in your social media account such as:

Facebook. Post Planner may allow you to connect a Facebook page or profile to your Post Planner account, in which case we will access certain information from Facebook regarding your account. In particular, we may collect profile image, display name, username/page ID or profile ID, access tokens, sent posts. This includes the content of your post and engagement data (such as click rates, likes, re-shares, impressions, as well as general engagement counts), to the extent permitted by applicable law. This data will only be used by Post Planner to provide you with the Service you expect and will not be shared with any third parties.

To request the deletion of your Facebook data, please do the following:

(1) Disconnect your Facebook account from Post Planner by following the instructions here:

Instagram. Post Planner may allow you to connect an Instagram profile to your Post Planner account, in which case we will access certain information from Instagram regarding your account. In particular, we may collect profile image, display name, username/profile ID, access tokens, and sent posts. This includes the content of your post and engagement data (such as click rates, likes, re-shares, impressions, as well as general engagement counts), to the extent permitted by applicable law. This data will only be used by Post Planner to provide you with the Service you expect and will not be shared with any third parties.

X/Twitter. Post Planner may allow you to connect a X/Twitter profile to your Post Planner account, in which case we will access certain information from X/Twitter regarding your account. In particular, we may collect profile image, display name, username / profile ID, access tokens, and sent posts. This includes the content of your post and engagement data (such as click rates, likes, retweets, re-shares, impressions, as well as general engagement counts), to the extent permitted by applicable law. This data will only be used by Post Planner to provide you with the Service you expect and will not be shared with any third parties.

Pinterest. Post Planner may allow you to connect a Pinterest page or profile to your Post Planner account, in which case we will access certain information from Pinterest regarding your account. In particular, we may collect profile image, display name, username / profile ID, access tokens, sent posts, and profile boards. This includes the content of your post and engagement data (such as click rates, likes, re-shares, re-pins, impressions, as well as general engagement counts), to the extent permitted by applicable law. This data will only be used by Post Planner to provide you with the Service you expect and will not be shared with any third parties.

LinkedIn. Post Planner may allow you to connect a LinkedIn profile to your Post Planner account, in which case we will access certain information from LinkedIn regarding your account. In particular, we may collect profile image, display name, username / profile ID, access tokens, and sent posts. This includes the content of your post and engagement data (such as click rates, likes, re-shares, impressions, as well as general engagement counts), to the extent permitted by applicable law. This data will only be used by Post Planner to provide you with the Service you expect and will not be shared with any third parties.

Additionally, if you connect X/Twitter, Facebook, or Instagram when utilizing Post Planner analytics we may collect: profile image, display name, username / handle, access tokens, social channels insights data and social accounts demographic data, sent tweets, social account's followers count, social account's insights data and social account's audience data.

TikTok. Post Planner may allow you to connect a TikTok profile to your Post Planner account, in which case we will access certain information from TikTok regarding your account. In particular, we may collect profile image, display name, username / profile ID, access tokens, and sent posts. This includes the content of your post and engagement data (such as click rates, likes, re-shares, impressions, as well as general engagement counts), to the extent permitted by applicable law. This data will only be used by Post Planner to provide you with the Service you expect and will not be shared with any third parties.

Google Business Profiles. Post Planner may allow you to connect a Google Business Profile to your Post Planner account, in which case we will access certain information from your Google Business Profile regarding your account. In particular, we may collect profile image, display name, username / profile ID, access tokens, and sent posts. This includes the content of your post and engagement data (such as click rates, likes, re-shares, impressions, as well as general engagement counts), to the extent permitted by applicable law. This data will only be used by Post Planner to provide you with the Service you expect and will not be shared with any third parties.

YouTube. Post Planner may allow you to connect a YouTube channel to your Post Planner account, in which case we will access certain information from Google and YouTube regarding your account. In particular, we may collect profile image, display name, profile ID, access tokens, existing videos. This includes the details of your video and engagement data (such as click rates, likes, re-shares, impressions, as well as general engagement counts), to the extent permitted by applicable law. This data will only be used by Post Planner to provide you with the Service you expect and will not be shared with any third parties. More information on Google’s Privacy Policy can be found here.

By connecting your YouTube account in Post Planner, you are agreeing to be bound by the YouTube Terms of Service.

To delete your stored YouTube data and/or revoke Post Planner's access to your YouTube data, you  may go to the Google security settings page.

Post Planner's use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

Personal Data of minors.

The Services are not intended for users younger than 16. We do not actively collect or otherwise process Personal Data from users under the age of 16. If we become aware that an individual under the age of 16 has submitted Personal Data without verifiable parental consent, we will remove his or her information from our files.

Personal Data we do not collect.

We do not actively collect or otherwise process personal data revealing racial origin, ethnic origin, political opinions, religious beliefs, philosophical beliefs, trade union membership, genetic data or biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation. We do not actively collect or otherwise process personal data relating to criminal convictions and offences.

4. COOKIES AND SIMILAR TRACKING TECHNOLOGIES 

We (and the third-party service providers working on our behalf) use various technologies to collect personal data. This may include saving cookies to your device. 5. HOW WE USE YOUR PERSONAL DATA

We use your Personal Data to operate our Services, fulfill our contractual obligations in our service contracts with customers, to review and enforce compliance with our Terms, guidelines, and policies, to analyze the use of the Services in order to understand how we can improve our content and service offerings and products, and for administrative and other business purposes. We process Personal Data for subscription services, payments, sales and marketing, employee training, data analysis, security monitoring, auditing, research, and to comply with applicable laws, exercise legal rights, and meet tax and other regulatory requirements.    

In this context, the legal basis for our processing of your Personal Data is either the necessity to perform contractual and other obligations, our legitimate business interest as a provider of security services, or to meet regulatory requirements.

6. SHARING OF PERSONAL DATA

We may share your Personal Data in the following circumstances: 

Social Media Platforms. We integrate with your social media profiles that you link to your account, including Facebook, Twitter, LinkedIn, Instagram, Pinterest, and Google and share your Personal Data as part of our Services. We also integrate with YouTube API Services. You can see the Google Privacy Policy here: http://www.google.com/policies/privacy

Third-party Service Providers. We may share information we collect about you with third-party service providers to perform tasks on our behalf in supporting the Services. The types of service providers to whom we entrust Personal Data include: (i) payment providers; (ii) providers of hosting services; (iii) sales and marketing providers; (iv) providers of analytic data services; and (v) other services such as system support.

Artificial Intelligence Models. Our application does not utilize Artificial Intelligence (AI) models that involve sharing, processing, or analyzing your Personal Data. Your Personal Data is utilized strictly for the purposes outlined in this Privacy Policy, without external sharing for AI modeling or similar purposes. 

Regulatory Bodies, Public Authorities, and Law Enforcement. We may access and disclose your Personal Data to regulatory bodies if we have a good-faith belief that doing so is required under applicable law or regulation. This may include submitting Personal Data required by tax authorities. We may disclose your Personal Data in response to lawful requests by public authorities or law enforcement, including to meet national security or law enforcement requirements. If we are going to release your Personal Data in this instance, our policy is to provide you with notice unless we are prohibited from doing so by law or court order.

Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, then your Personal Data may be transferred as part of such a transaction as permitted by law and/or contract. Should such an event occur, Post Planner will endeavor to direct the transferee to use Personal Data in a manner that is consistent with the Privacy Policy in effect at the time such Personal Data was collected.

Other Disclosures. We may also disclose your Personal Data to exercise or defend legal rights; to take precautions against liability; to protect the rights, property, or safety of the Services, of any individuals, or of the general public; to maintain and protect the security and integrity of our services or infrastructure; to protect ourselves and our services from fraudulent, abusive, or unlawful uses; or to investigate and defend ourselves against third-party claims or allegations. Disclosures may be made to courts of law, attorneys and law enforcement, or other relevant third parties in order to meet these purposes.

Please note that we share aggregated information and non-identifying information with third parties for industry research and analysis, demographic profiling, and other similar purposes. In addition, our Services may contain links to other websites not controlled by us, and these other websites may reference or link to our Services; we encourage you to read the privacy policies applicable to these other websites.

California Consumer Privacy Act of 2018 (“CCPA”)

We do not sell your personal information. The categories of Personal Data we have collected about consumers and disclosed about consumers for a business purpose in the preceding 12 months are:

  • Identifiers such as a real name, alias, email address, unique personal or online identifier, Internet Protocol address, account name;
  • Commercial information, including products or services purchased, obtained, or considered; other purchasing or consuming histories or tendencies;
  • Internet or other electronic network activity information, including, browsing history, search history, and information regarding a consumer’s interaction with an internet website, or advertisement;
  • Professional or employment-related information; and
  • Inferences drawn from any of the information identified to create a profile about a consumer reflecting the consumer’s preferences, intelligence, abilities, and aptitudes.

7. RETENTION OF PERSONAL DATA

Post Planner retains Personal Data for a reasonable time period to fulfill the processing purposes mentioned above. Personal Data is then archived for time periods required or necessitated by law or legal considerations. When archival is no longer required, Personal Data is deleted from our records.

We retain your account information, including Personal Data integrated through your linked social media profiles, for the duration of your paid subscription service. After termination of your subscription, your account is retained as part of our free service. We may delete your account if it has not been used in over 12 months or if you specifically ask that we delete your account by submitting your request through our contact information provided at the end of this policy. 

We retain Personal Data that we are required to retain to meet our regulatory obligations including tax records and transaction history. For example, we retain information associated with subscription payments as part of that transaction. We regularly review our retention policy to ensure compliance with our obligations under data protection laws and other regulatory requirements. We regularly audit our databases and archived information to ensure that Personal Data is only stored and archived in alignment with our retention policies.

8. PROTECTION OF PERSONAL DATA

Post Planner uses technical and organizational measures to protect the Personal Data that we store, transmit, or otherwise process, against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. We regularly consider appropriate new security technology and methods as we maintain and develop our software and systems. Please be aware that despite our best efforts to ensure the security of your data, we cannot guarantee that your information will be 100% secure.

Please recognize that protecting your Personal Data is also your responsibility. We urge you to take every precaution to protect your information when you are on the Internet, such as using a strong password and keeping your password secret. If you have reason to believe that the security of your account might have been compromised (for example, your password has been leaked), or if you suspect someone else is using your account, please let us know immediately.

9. INTERNATIONAL DATA TRANSFER

Your Personal Data may be transferred to, and maintained on, computers located outside of your state, province, country, or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside the United States and choose to provide your Personal Data to us, we will transfer your Personal Data to the United States and process it there. Where we transfer your Personal Data, we will take all reasonable steps to ensure that your privacy rights continue to be protected. In the case of transfers of data out of Europe, we implement Standard Contractual Clauses and endeavor to use third-party service providers from the United States that have certified with Privacy Shield and have implemented adequate transfer protections that are compliant with the EU General Data Protection Regulation (“GDPR”).

10. PRIVACY RIGHTS

If you have a Post Planner account, we rely upon you to keep your information up to date. You may edit your profile information at any time through your account settings. To cancel your Post Planner account, you need to send an email with the text “Please cancel my Post Planner account.” Our email address is provided in the contact details at the end of this policy. For email communication of a marketing nature and for our subscribed communications, we provide the ability for you to unsubscribe directly from the email. You can manage the social media profiles you link to your account. We publish information on how to manage your links at https://help.postplanner.com/en/ as part of our support library. 

If we rely upon consent as a legal basis for processing, you may withdraw your consent at any time. Please note the withdrawal of your consent does not affect the lawfulness of processing based on consent before withdrawal.

Individuals in the EEA, UK, and Switzerland have certain rights which may be subject to limitations and/or restrictions. These rights include the right to: (i) request access to and rectification or erasure of their Personal Data; (ii) obtain restriction of processing or to object to processing of their Personal Data; and (iii) ask for a copy of their Personal Data to be provided to them, or a third party, in a digital format. If you wish to exercise one of the above-mentioned rights, please send us your request to the contact details set out below. Individuals also have the right to lodge a complaint about the processing of their Personal Data with their local data protection authority.

Personal Data subject rights under the CCPA may also apply to certain individuals and households. These rights include the right to: (i) know what Personal Data is being collected about them, (ii) know whether their Personal Data is sold or disclosed at to whom, (iii) say no to the sale of Personal Data, (iv) access their Personal Data, and (v) equal service and price, even if they exercise their privacy rights.

11. EFFECTIVE DATE AND AMENDMENTS

This document is effective as of the date indicated at the top of this Privacy Policy under “Last updated”. This document may be amended from time to time.
